Information Security and Confidentiality

We work hard to protect Alpha Yachts, our users, and specifically the data we hold from:

  • Unauthorized access

  • Unauthorized alteration

  • Disclosure, and

  • Destruction

No users are allowed access to the confidential transaction information of any other user, including the clients or contracts that are pending or fully executed. In order to avoid any conflicts of interest, this includes officers of Alpha Yachts with current ownership interests in any yacht brokerage company. Those officers are granted access to their own brokerage’s confidential information and to none other.

We restrict access to information to Alpha Yachts employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

This Privacy Policy applies to AlphaYachts.com only (the “Site”). It does not apply to other websites to which we link. Because we gather certain types of information about our users, we want you to understand what information we collect about you, how we collect it, how that information is used, and how you can control our disclosure of it. You agree that your use of the Site signifies your assent to this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Site.

Information Collected

We collect two types of information from you: i) information that you voluntarily provide to us (e.g. Registration Data (as such term is defined in the Terms of Use) through a voluntary registration process, sign-ups, information and data entered into Forms (as such term is defined in the Terms of Use), and emails); and ii) information that is derived through automated tracking mechanisms.

Voluntary Registration Information

In order to fully access this Site, you must first complete the registration process, during which we will collect personal information about you. The information will include your name, company name, address, email address, telephone numbers, etc.

By registering with us, you consent to the use and method of disclosure as described in this Privacy Policy.

Voluntary Information for Services and Features

We collect personally identifiable information when you choose to use certain features of the Site, including, but not limited to: i) completing, submitting, receiving and signing Forms, and ii) consenting to receive email. When you choose to use these features, we require you to provide your “Contact Information” in addition to other personal information that may be required to complete a transaction such as your phone number, billing and shipping addresses and credit card information. We will also collect any and all data that may be completed on the Forms. Occasionally, we may also request information such as usage preferences and demographics, which will help us better serve you and our other users in the future.

Cookies

Our site uses “cookies” and other tracking technologies. Cookies enable us to serve secure pages to our users without asking them to sign in repeatedly. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. If a user’s system is idle for a defined time, the cookie will expire, forcing the user to sign in again to continue their session. This prevents unauthorized access to the user’s information while they are away from their computer.

You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser, but please note that if you choose to erase or block your cookies, you will need to re-enter your original user ID and password to gain access to certain parts of the Site.

Referrals

You may choose to invite friends to join AlphaYachts.com or participate in a transaction being facilitated by AlphaYachts.com, by sending invitation emails. AlphaYachts.com stores the email addresses you provide so that the respondents may be added to your network, confirm orders/purchases and also to send reminders of the invitations. AlphaYachts.com does not sell these email addresses or use them to send any other communication besides invitations and invitation reminders. Recipients of invitations may contact AlphaYachts.com to request removal of their information from our database. You represent and warrant that you are duly authorized to provide such emails and submit other such personal information to AlphaYachts.com.

How We Use Your Information

AlphaYachts.com only uses your personal information for the original purposes it was given. Your personal information will not be sold or otherwise transferred to unaffiliated third parties without your approval at the time of collection. You understand that, in the process of facilitating a transaction, personal information (including Registration Data and information entered into a AlphaYachts.com Form) will be submitted, and made available to, other parties in the transaction (including, without limit, buyers, sellers, and brokers). If you are entering data on behalf of another party, you represent and warrant to Alpha Yachts that you are duly authorized to do so.

Notwithstanding anything to the contrary herein, AlphaYachts.com reserves the right to collect and publish information in aggregate form (i.e. in a form that will not specifically disclose your name, email or physical address, or other unique personal information). However, information such as, and for purposes of example only, total value of all transactions facilitated by Alpha Yachts, may be collected and published without uniquely identifying you. Such information may be used for marketing and other purposes, in the sole discretion of Alpha Yachts.

Except as specifically described herein, AlphaYachts.com will not disclose, use, give or sell any personal information to third parties for any purposes other than to our suppliers, accountants, agents, attorneys, and other third parties in order to deliver services on behalf of Alpha Yachts.com, unless required to do so by law. Further, AlphaYachts.com reserves the right to contact you regarding matters relevant to the underlying service provided and/or the information collected. You may also be contacted by other parties and participants in a transaction facilitated by AlphaYachts.com.

Please note that personally identifiable information is used only to provide you with a more enjoyable, convenient online experience and to help us identify and/or provide information, products or services that may be of interest to you. We use your personally identifiable information to support and enhance your use of the Site and its features, including without limitation: providing customer service; tracking email invitations you send; and otherwise supporting your use of the Site.

Alpha Yachts may use your personal information for target advertising toward you based on things such as region, gender, interests, goals, habits, etc.

We may permit certain trusted third parties to track usage, analyze data such as the source address that a page request is coming from, your IP address or domain name, the date and time of the page request, the referring Web site (if any) and other parameters in the URL. This is collected in order to better understand our Web site usage, and enhance the performance of services to maintain and operate the Site and certain features on the Site. We may use third parties to host the Site; operate various features available on the Site; send emails; analyze data; provide search results and links and assist in fulfilling your orders.

Also, we may share personally identifiable or other information with our parent, subsidiaries, divisions, and affiliates.

We may transfer personally identifiable information as an asset in connection with a proposed or actual merger or sale (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate reorganization, stock sale or other change in control.

AlphaYachts.com may disclose Contact Information in special cases where we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our terms and conditions of use or may be causing injury or interference with our rights, property, our customers or anyone who could be harmed by such activities.

WE ARE NOT LIABLE OR RESPONSIBLE FOR THE PERSONALLY IDENTIFIABLE OR OTHER INFORMATION YOU CHOOSE TO SUBMIT IN (I) THE PROCESS OF COMPLETING A TRANSACTION OR FORM, OR (II) FORUMS SUCH AS A BULLETIN BOARD, CHAT ROOM OR ANY OTHER PUBLICLY ACCESSIBLE AREA OF THE SITE.

You will receive notice when your personally identifiable information might be provided to any third party for any reason other than as set forth in this Privacy Policy, and you will have an opportunity to request that we not share such information.

We use non-identifying and aggregate information to better design our website and for business and administrative purposes. We may also use or share with third parties for any purpose aggregated data that contains no personally identifiable information.

How We Protect Your Information

We are committed to protecting the information we receive from you. We take appropriate security measures to protect your information against unauthorized access to or unauthorized alteration, disclosure or destruction of data. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we maintain appropriate physical, electronic, and managerial procedures to safeguard and secure the information and data stored on our system. Third-Party Advertising

Advertisements appearing on this Site may be delivered to you by AlphaYachts.com or one of our Web advertising partners. Our Web advertising partners may set cookies. Doing this allows the advertising partners to recognize your computer each time they send you an advertisement. In this way, they may compile information about where you, or others who are using your computer, saw their advertisements and determine which advertisements are clicked. This information allows an advertising partner to deliver targeted advertisements that they believe will be of most interest to you. AlphaYachts.com does not have access to or control of the cookies that may be placed by the third party advertising servers of ad partners.

This privacy statement covers the use of cookies by AlphaYachts.com and does not cover the use of cookies by any of its advertisers.

Accessing and Updating Your Personal Information and Preferences

We provide mechanisms for updating and correcting your personal information for many of our services. You may modify or remove any of your personal information at any time by logging into your account and accessing features such as edit and account.

Email Choice/Opt-out

If you no longer wish to receive updates or notifications may opt-out of receiving these communications by blocking emails from AlphaYachts.com using your email program.

Children’s Privacy and Parental Controls

We do not solicit any personal information from children. If you are not 18 or older, you are not authorized to use the Site. Parents should be aware that there are parental control tools available online that can be used to prevent children from submitting information online without parental permission or from accessing material that is harmful to minors.

Disclaimer to Security

By consenting to the Terms of Use of the Site and hence the Privacy Policy, you consent that no data transmission over the Internet is completely secure. We cannot guarantee or warrant the security of any information you provide to us, and you transmit such information to us at your own risk.

Notification of Changes

AlphaYachts.com reserves the right to change this Privacy Policy from time to time at its sole discretion. If at some point in the future, there is a change to our Privacy Policy, unless we obtain your express consent, such change will only apply to information collected after the revised Privacy Policy took effect. Your continued use of the Site indicates your assent to the Privacy Policy as posted.

Purpose of processing

Alpha Yachts will use your personal information collected via the Website for the following purposes:

to control your identity; send you the newsletter if you signed up for this service; send you any information you explicitly requested; locate the dealer closest to you, and provide any other service you may require (“Providing the Service”);

to send you communications and/or commercial offers and/or and any informative material regarding our brands and models; invite you to events (public or private), fairs and/or boat shows, send you promotional communications, market research and surveys related to products and services offered Alpha Yachts or send you our house organ. Depending on the type of communication, we can contact you by email and/or telephone and/or messaging services and/or ordinary mail and/or social networks (“Marketing”);

to create your profile through the use of profiling cookies, subject to your authorization, collecting and analyzing information about the selections and choices you make on the Website and about how you use the Website in general. This profile will be used to send you information about other sites and /or services that Alpha Yachts thinks might be of interest to you, and to show you advertising that may match your preferences. (“Preferences”);

to comply with legal obligations whereby Alpha Yachts must collect and/or process certain types of personal information (“Compliance”);

to prevent or identify any abusive use of the Website or any fraudulent activity (“Abuse/Fraud”).

Recipients of your personal information

Your personal information may be shared with the persons indicated below (“Recipients”):

Anyone typically acting as the data processor, such as: i) persons, companies or professionals providing assistance and consulting services to Alpha Yachts for accounting, administration, legal, taxation, financial and debt collection associated with the delivery of the services we offer (“Services”);

Anyone with whom interaction is necessary in order to provide the Services (such as hosting providers or suppliers of platforms for sending mail);

Anyone authorized to handle technical maintenance (including maintenance of networking equipment and electronic communications networks);

Persons authorized by Alpha Yachts to process personal information as required for actions closely linked to the provision of the Services, whether they are under the obligation of confidentiality or have a suitable legal obligation of confidentiality (i.e. employees of Alpha Yachts);

Alpha Yachts for the purpose of internal administration, including the processing of Personal information of customers and employees;

Subjects, agencies or authorities to whom it is obligatory to notify your personal information for the purpose of Compliance, Abuse or Fraud prevention, or by order of the authorities.

Transfer of personal information

In light of the international scope of Alpha Yachts, some of your personal information may be shared with Recipients who may be located outside of the United States. Alpha Yachts assures you that the processing of your personal information by these Recipients will comply with applicable regulations.

Retention of Personal Information

Personal information processed for the purpose of Providing the Services will be retained by Alpha Yachts for the time strictly necessary to achieve this purpose. However, since your personal information was processed in order to supply the Services to you, Alpha Yachts may retain them for a longer period, especially if necessary for protecting the interests of Alpha Yachts against potential liability in relation to the Services.

Personal information processed for the purposes of Marketing and Preferences will be retained by Alpha Yachts until you withdraw the authorization you gave earlier and regularly renewed. After you have withdrawn your authorization, Alpha Yachts will no longer use your personal information for these purposes, but may retain it, especially if this is necessary to protect the interests of Alpha Yachts against potential liability based on said processing.

Personal information processed for the purpose of Compliance will be retained by Alpha Yachts for the period stipulated in the specific legal obligations or in the applicable regulations.

Personal information processed for the purpose of preventing Abuse/Fraud will be retained by Alpha Yachts for the period strictly necessary for said purpose and thus until the moment when Alpha Yachts is required to retain them to protect itself legally for notification to the competent Authorities of said information.

Data Subject Rights

You have the right to ask Alpha Yachts, at any time:

To gain access to your personal information (and/or a copy of said personal information) as well as additional information about any ongoing processing of them;

To have your personal information, processed by Alpha Yachts, corrected or updated, should it be incomplete or be out of date;

To have your personal information deleted from the database of Alpha Yachts, should you consider the processing to be unnecessary or unlawful;

To limit the processing of your personal information by Alpha Yachts, should you consider your personal information to be incorrect, unnecessary, or processed unlawfully, or should you have refused processing;

To exercise your right to data portability, meaning obtaining a copy of the personal information supplied to Alpha Yachts about you, in a structured format, commonly used and that can be read by an automatic device, or to ask for it to be sent to another Data Controller;

To refuse the processing of your personal information, using a legal premise related to your personal situation that you consider should prevent Alpha Yachts from processing your personal information; or

To withdraw your authorization for Marketing and Preferences purposes.
